The article considers legislation and law-making in the field of succession in the period of the Soviet state. The author examines the legal position of academic jurist concerning the institution of inheritance by the will under conditions of multiplicity of regulations, origination of the legal system of the new state. The article concludes about elimination of free will, restriction of private property under the conditions actually imposed by the order of distribution of property between the state and a certain range close to the deceased persons.
